O R D E R

% 26.11.2025 1.

The present Petition under Section 14 (1) and 15 of the Arbitration and Conciliation Act, 196 has been filed by the Petitioners for appointment of a substitute Arbitrator for adjudicating the disputes between the parties. 2.

This Court vide Order dated 23.11.2023 in ARB.P. 982/2023 appointed Mr. S.K Sarvaria, District and Session Judge (Retd.) as the Sole Arbitrator to adjudicate the disputes between the parties. It is stated that Claimant's witnesses were being examined when the learned Sole Arbitrator recused himself from the arbitration proceedings on account of ill-health. The Petitioners have approached this Court seeking appointment of a Substitute Arbitrator.

In view of the fact that disputes have arisen between the parties and there is an arbitration clause in the Agreement, this Court is inclined to The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. appoint an Arbitrator to adjudicate upon the disputes between the parties. 4.

Accordingly, Mr. Abhilash Mathur, Advocate (Mob: 9811041536) is appointed as the Sole Arbitrator to adjudicate upon the disputes between the parties.

The arbitration would take place under the aegis of the Delhi International Arbitration Centre (DIAC) and would abide by its rules and regulations. The learned Arbitrator shall be entitled to fees as per the Schedule of Fees maintained by the DIAC.

DIAC is also directed to consider the issue of fee already deposited by the parties in accordance with the DIAC Rules. 7.

The learned Arbitrator is also requested to file the requisite disclosure under Section 12(2) of the Arbitration & Conciliation Act within two weeks of entering the reference.

All rights and contentions of the parties in relation to the claims/counter-claims are kept open, to be decided by the learned Arbitrator on their merits, in accordance with law.

Needless to say, nothing in this order shall be construed as an expression on the merits.

10.

The present petition stands disposed of in the above terms along with pending application(s), if any.
