% 09.04.2018 After some hearing, the counsel for the petitioner submits that he may be permitted to withdraw the captioned petition and the applications filed therewith and instead seek restitution of the portion of which the petitioner has been wrongfully divested in execution of the decree, the executing court having gone beyond its scope by order dated 20.01.2017 which is subject matter of challenge in the appeal presently pending since revived by the impugned order. The petition and the applications filed therewith are dismissed as withdrawn with liberty as prayed granted.
