The instant petition is for the following reliefs:- "a) Issue a writ of mandamus or any other appropriate writ, order or direction to permit the petitioners to reopen and operate their licensed shops in Mehrauli with police protection, for enforcement of Fundamental Rights under Articles 19(1)(g) and 21. b) Direct the Respondents to take preventive action against anti-social elements causing unlawful interference with the business of the Petitioners;

c) Any other relief which this Hon'ble Court deem fit and proper under the circumstances of the case in the interest of justice." 2.

The status report filed by the respondent-Municipal Corporation of Delhi ('MCD') clearly states that the petitioners had obtained license from the Veterinary department for running their respective shops. According to the MCD, on account of the intervention of certain local residents, the shops have been closed, however, no formal notice or formal communication was made by the MCD.

If the petitioner has any grievance with respect to the local residents, he will have to institute a civil suit and seek an injunction against them. There does not seem to be any action taken by the State authorities against the petitioner, therefore, no mandamus can be issued under the facts. 4.
