% 12.07.2018 The present petition has been filed by the petitioner with the following prayers:
"It is therefore most respectfully prayed that in the interests of justice, this Hon'ble Court may kindly be pleased to: a) issue a writ order or direction in the nature of mandamus or any other similar writ or order, thereby commanding the respondents not to dispossess the petitioner without due process of law from the land bearing Kh. No. 47/8 (5-7) situated in the revenue estate of Village Jonapur, Tehsil Mehrauli, New Delhi; and b) pass such other and further orders as deemed fit and proper in the facts and circumstances of the case in favour of the petitioners."
Mr. Anjum Javed, learned Additional Standing Counsel appearing for the respondents has drawn my attention to para 2 of the para-wise reply wherein the following has been stated:
"2. That the contents of the paragraph 2 are wrong and denied. The land is lying uncultivated, therefore, Khasra Girdwari was not filled-up. As this land was allotted to this petitioner solely for agricultural purpose. The petitioner is liable for action u/S-65-A of Delhi Land Reforms Act, 1954." Mr. Anjum Javed also states that from para 2 of the para-wise reply it is clear that the petitioner can be ejected pursuant to action under Section 65-A of Delhi Land Reforms Act, 1954.
In view of the stand of the respondents and also the submissions made by Mr. Anjum Javed, Mr. Pankaj Vivek, learned counsel for the petitioner states, nothing further survives in this petition; the same be dismissed as withdrawn. Ordered accordingly.
