This writ petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeks directions to the competent authority to release the Petitioner on furlough for a period of three weeks.

The Petitioner was granted furlough by order of this Court dated 8th January, 2024, subject to certain conditions. Since the Petitioner was unable to comply with those conditions, he filed CRL.M.A. 11121/2024 seeking modification of the conditions, which was heard and dismissed by order dated 18th July, 2024.

Despite the rejection of his request for modification, the Petitioner has once again approached this Court seeking furlough in terms of the order The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. dated 8th January, 2024. Upon a specific query from the Court as to whether he is now in a position to comply with the conditions imposed earlier, counsel for the Petitioner answered in the negative and instead requested that the conditions be modified.

Given the earlier refusal to modify the conditions, the present petition does not appear to be maintainable.

In light of the above, counsel for the Petitioner submits that he would like to withdraw the present petition and seeks liberty to move an application for review of the order dated 18th July, 2024. 6.

Dismissed as withdrawn with the liberty as aforesaid. 7.

It is clarified that whether such a review is maintainable or not will be a matter for the concerned Bench to consider. 8.

Pending application also stands dismissed.
