O R D E R

The present petition has been filed seeking issuance of writ of mandamus directing the release of petitioner on parole for a period of four weeks in connection with his conviction in FIR No. 72/2011 under Section 302/392/120B/34 IPC registered PS Vivek Vihar. 2.

Ms. Gayatri Nandwani, learned counsel appearing on behalf of the petitioner submits that the application was filed by the petitioner seeking parole for the purpose of filing SLP against the judgment in appeal whereby his conviction was upheld by this Court.

She submits that the application was filed almost 133 days ago and the same has not been disposed of despite the statutory mandate being disposal of the such applications within a period of four weeks. 4.

In view of the above, Mr. Rahul Tyagi, learned ASC for the state accepts notice.

On instructions, he submits that the state has no objection in case the parole for a period of four weeks is granted to the petitioner to enable him to file the SLP against the judgment of dismissal of his appeal. 6.

He further apprise the Court that the concession is being given by the State since the petitioner had earlier availed furlough this year and there was no misuse of the liberty granted to him.

In view of the above, petition is allowed.

Consequently, it is directed that the petitioner be released on parole for a period of four weeks from the date of his release, subject to him furnishing a Personal Bond in the sum of Rs. 10,000/- with one surety in the like amount to the satisfaction of the Jail Superintendent, further subject to the following conditions:

(a) The petitioner shall not leave the NCR region without informing the Jail Authorities concerned; and (b) The petitioner shall provide his mobile number to the Jail Authorities concerned which shall be kept in working condition at all times. 9.

Upon expiry of period of parole of four weeks as stated above, the petitioner shall surrender before the Jail Superintendent. 10.

The petition is disposed of, in the above terms. 11.

The present order has been passed in the peculiar facts and circumstances of the case, as noted hereinabove. 12.

Copy of the order be forwarded to the Jail Superintendent for information and necessary compliance.
