CM. APPL.No. 18958/2016 (for condonation of delay) In view of the averments made in the application, the delay of 3 days in refiling this petition is condoned. Application disposed of. CM(M) 489/2016 Petitioner is aggrieved by the order dated 20.01.2016 vide which the application filed by the tenant seeking extension of time to make payment of arrears of rent has been considered without petitioner / landlord have been given an opportunity to address arguments on that issue and condonation of delay sought for by the tenant in the deposit of the afore noted arrears have been granted in favour of the tenant. This submission made by the counsel for the
petitioner is borne out from the record. The order dated 21.01.2016 speaks by itself.
The Trial Court shall reconsider the application filed by the tenant seeking condition of delay in deposit of rent. The reasons for the delayed payment and as to whether the petitioner / landlord would be entitled to interest for the delayed payment shall also be considered by the Trial Court.
No further orders are called for.
