% 06.04.2016 CM No.9976/2016 (exemption) Exemption is allowed, subject to all just exceptions. FAO(OS) 89/2016 When the learned counsel for the appellants was confronted with the question as to how this appeal was maintainable under Section 37 of the Arbitration & Conciliation Act, 1996, the learned counsel sought permission to withdraw the same with liberty to take recourse to such provisions of law as may be available to him to seek remedy against the order dated 08.02.2016 passed by a learned Single Judge in IA No.20349/2015 and IA No.22452/2015, both of which were applications under Section 151 CPC in a disposed of Arbitration Petition No.229/2013, which was filed by the respondent herein under Section 11(6) of the said Act. The learned counsel for the appellants also states that he would not be filing any reply to the abovementioned applications, as according to him, the learned Single Judge does not have jurisdiction to entertain those applications. The appeal is dismissed as withdrawn with the aforesaid liberty. Dasti.
