% 26.09.2017 On earlier dates the petitioner had take time on a submission made that a connected matter i.e. the SLP No.16106/2012 titled Gaon Sabha and Anothers Vs. Indu Khurana and Anothers is pending before the Apex Court; submission was that the outcome of the said SLP would have a bearing on the instant case. On this count only the matter being adjourned time and again. On the last date i.e. 12.7.2017 it had been brought to the notice of this Court that the SLP now stands dismissed. A copy of the order dated 05.4.2016 of the Apex Court dismissing the SLP (against the order dated 02.12.2010 passed by the High Court of Delhi in WP(C) 4143/2003 Gaon Sabha and Anr Vs.
Indu Khurana and Anr.) has been placed on record. Counsel for respondent points out that noting now survives in this petition. Learned counsel for respondent seeks an adjournment. This Court is not inclined to adjourn the matter. This Court notes that the issue in the instant case whether the land becomes urbanized in terms of notification issued under Section 507(a) of the Delhi Municipal Corporation Act, 1957, the provisions of the Delhi Land Reforms Act, 1954 will cease to apply. The said notification is on record. This relates to the land falling in Khasra Nos.20,22 and 59 of Village Saboli which is the subject matter of present petition. The order impugned before this Court is the order passed by the Financial Commissioner on 11.11.2011 who was also of the same view. He had held that the provisions of the Delhi Reforms Act will cease to apply once the land stands notified under Section 507(a) of the DMC Act.
This petition has become infructuous. It is disposed of accordingly.
