HON'BLE MR. JUSTICE SANJEEV SACHDEVA

O R D E R

% 12.04.2018 Crl. M.A. 5795/2018(exemption) Allowed, subject to all just exceptions.

CRL.M.C. 1595/2018 1.

Learned counsel for the petitioners seeks impleadment of co-accused Sajid Khan and Mobin.

2.

On the oral prayer of learned counsel for the petitioners, Sajid Khan and Muvin are impleaded as Petitioner Nos.3 & 4. 3.

Amended memo of parties along with supporting affidavit have been filed by the petitioners vide Diary No.107916 of today's date. 4.

The Registry is directed to place the same on record. 5.

Petitioners seek quashing of FIR No.659/2015, under Sections

341/354-B/506/34 IPC, Police Station Nangloi, based on a Settlement. 6.

Parties have settled their disputes through the process of Mediation and a Settlement Agreement dated 15.02.2017 has been entered into between the parties before the Mediation Centre, Tis Hazari Courts, Delhi. 7.

The complainant/Respondent No.2 as well as her sister Ms Farzana are present in Court in person, is represented by counsel and identified by the Investigating Officer. They confirm that they have arrived at a Settlement and further submit that they do not wish to press their complaint any further.

8.

In view of the above and keeping in view of the fact that the parties have resolved their disputes through the process of Mediation and a Settlement Agreement dated 15.02.2017 has been entered into between the parties before the Mediation Centre, Tis Hazari Courts, Delhi, and further that respondent No.2 does not wish to press charges, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.

9.

Accordingly, FIR No.659/2015, under Sections 341/354-B/506/34 IPC, Police Station Nangloi, and the consequent proceedings emanating therefrom are hereby quashed.
