% 02.04.2018 Respondent no.2-Sabiha Khatun is present in Court along and has been identified by SI Omveer Singh of police station Nand Nagri. She submits that she has settled the matter with petitioner no.1 of her own free will and without any undue force, pressure or coercion before the Delhi Mediation Centre, Karkardooma Courts, Delhi on 29th September, 2016. She further submits that in view of the settlement she does not wish to pursue the FIR No. 336/2013 under Sections 498A/406/34 IPC and Section 4 of the Dowry Prohibition Act registered at police station Nand Nagri against the petitioner no.1 and his relatives, that is, petitioner nos. 2 and 3. Affidavit of respondent no.2 is also on record as Annexure P-4.
Keeping in mind the settlement arrived at between the respondent no.1 and petitioner no.1voluntarily, I am of the view that no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, the aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
