Petitioner seeks quashing of FIR No.08/2017 under Sections 354/289/323/509/34 IPC, Police Station Sangam Vihar, based on a Settlement.

Parties are stated to be neighbours and known to each other. 3.

The subject FIR was registered, consequent to a dispute which took place on account of lending of money.

With the intervention of the respectable elder members of the Society, the parties have amicably settled their disputes. Memorandum of Understanding dated 22.03.2018 has been entered into between the parties 5.

As per the Settlement, the loan amount of Rs.10,000/- was agreed to be returned to respondent No.2.

Respondent No.2 is present in Court in person is identified by the Investigating Officer. She confirms that parties have arrived at a Settlement with a view to maintain peace and harmony in the locality and she has received the said amount of Rs.10,000/- and further submits that she does not wish to press her complaint any further. 7.

In view of the above and keeping in view of the fact that the parties have resolved their dispute with the intervention of respectable members of the Society with a view to restore peace and harmony between them and a Memorandum of Understanding dated 22.03.2018 has been entered into between the parties and further respondent No.2 does not wish to press charges against the petitioners, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.

Accordingly,FIR No.08/2017 under Sections 354/289/323/509/34 IPC, Police Station Sangam Viharand the consequent proceedings emanating therefrom are hereby quashed. 9.
