By virtue of the application being CM APPL. 32946/2025, the petitioner seeks withdrawal of the present petition, primarily on the ground that Civil Suit CS No. 58887/2016 titled "Om Prakash Arora @Om Arora v. M/S. New Line Information System Pvt. Ltd" before the Additional District Judge-03, Patiala House Courts, New Delhi was instituted in view of the amendment of the Commercial Court Act, 2015 (CC Act) being carried out in 2018.

Learned counsel for the petitioner seeks to withdraw the present petition as the same was inadvertently filed without taking into consideration that the Commercial Courts, Commercial Division, and Commercial Appellate Division of High Courts (Amendment) Act of 2018 (CC Act) only came into force on 03.05.2018, i.e. after institution of the said suit. As such, since the said suit was instituted before on 05.10.2016, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. according to him the said CC Act will have a prospective effect, and thus, has no application.

For the reasons stated in the present application, as also considering the submissions made by the learned counsel for the petitioner, the present application is allowed and in view thereof, the present petition is dismissed as withdrawn with liberty to continue adjudication the suit i.e., Civil Suit CS No. 58887/2016 titled "Om Prakash Arora @Om Arora v. M/S. New Line Information System Pvt. Ltd" before the Additional District Judge -03, Patiala House Courts, New Delhi. SAURABH BANERJEE, J.
