The learned Family Court has dismissed the application filed by the Appellant seeking grant of maintenance pendente lite. 2.

The parties have two children. The son is residing with the Appellant, whereas the daughter is residing with the Respondent. 3.

As per the affidavit on record, the Respondent is earning Rs. 9,000/- per month. The Appellant, on the other hand, claims that she is incurring an expenditure of Rs. 14,000/- per month towards the total expenses of the son, with financial assistance from her brother and parents.

It is evident that no material has been placed on record to controvert or assail the stated income of the Respondent. It is also undisputed that both the Appellant and the Respondent are working. In these circumstances, the present Appeal is disposed of with liberty granted to the Appellant to file a fresh application before the learned Family Court, along with appropriate material to establish the income of the Respondent.
