This petition has been filed seeking quashing of FIR No.70/2024 dated 15th March 2024, under Section 324 of IPC, registered at P.S. Hauz Qazi, basis settlement dated 14th November 2024, which is on record of this Court.

Both petitioner and respondent no.2 are present in the Court and are duly identified by the IO and the respective counsel. 3.

As per the settlement, outstanding balance of Rs.4 lakhs has been tendered to respondent no.2 who has duly received it in Court and states that he has no objection to the FIR being quashed. 4.

Petitioner and respondent no.2 state that they have known each other, and the issue arose out of altercation between them resulting in assault by petitioner. friends and after consuming liquor together, some argument started which led to the above incident.

APP for the State, however, objects to quashing of the FIR considering the nature of the incident, and the use of petrol by portioner for assaulting respondent no.2.

However, in view of the fact that the dispute was private in nature and there was no other victim in the said incident, as also considering the above settlement between the parties, there is no use continuing with proceedings of the present FIR as it would be a misuse of the process of the Court and an unnecessary burden on the State exchequer. 7.

Accordingly, the petition is allowed. Consequently, the FIR No.70/2024 dated 15th March 2024, under Section 324 of IPC, registered at P.S. Hauz Qazi and proceedings emanating therefrom are quashed. 8.

Parties shall abide by the terms of settlement. 9.

Accordingly, the petition is disposed of. Pending application is disposed of as infructuous.
