% 31.01.2017 Learned counsel appearing on behalf of the petitioner has stated that a suit bearing CS (Comm) No.57/2015 arising out of the same dispute as in the present company petition has been decreed by way of order of this court dated 18.7.2016. Learned counsel for the petitioner has handed over a copy of the said order in court. The same is taken on record.

In view of the satisfaction of the decree, learned counsel for the petitioner seeks leave to withdraw the present petition. Leave granted.

Consequently, the company petition is dismissed as withdrawn and disposed of accordingly. Pending applications also stand disposed of. SIDDHARTH MRIDUL, J.
