The petitioner has filed the present petition praying inter alia for quashing of the order dated 29th September, 2015, passed by the respondent -Director General, CISF, upholding the penalty of dismissal from service awarded by the disciplinary authority and upheld by the appellate authority and thereby, rejecting his representation dated 10th August, 2015.

In the course of the arguments, learned counsel for the petitioner has been confronted with the observations made in para- 6 (i) of the order dated 29th September, 2015, to the effect that the petitioner had admitted to the charge levelled against him of marrying another lady during the life W.P.(C) 2261/2016

time of his spouse, which is in violation of Rule 18 of CISF Rules, 2001 and Rule 21 of CCS (Conduct) Rules, 1964.

At this stage, learned counsel for the petitioner states that instead of assailing the impugned orders on merits, he may be permitted to withdraw the present petition, with liberty to file a fresh petition wherein the aspect of proportionality of the punishment inflicted upon the petitioner shall be agitated.

Leave as prayed for is granted.
