$~3 *
IN THE HIGH COURT OF DELHI AT NEW DELHI
+ CRL.M.C. 2588/2013 MADAN LALSURYAVANSHI ..... Petitioner Represented by:
None versus STATE OF NCT OFDELHI & ORS.
..... Respondents Represented by:
Mr.Amit Ahlawat, APP with Insp.Ravindra Ahlawat,
CORAM:
HON'BLE MR. JUSTICE PRADEEP NANDRAJOG
O R D E R
% 14.09.2016 1.
The matter was listed for September 13, 2016 which was declared a holiday and therefore is being taken up today. 2.
Though none appears for the petitioner I have perused the petition and I am constrained to dismiss the same for the same it lays a challenge to an order dated August 22, 2012 dismissing Criminal Revision No.32/2012 holding that no sufficient reasons have been disclosed as to why the criminal revision petition was filed belatedly.
3.
The impugned order would evince that an application was not filed praying for delay in filing the revision to be condoned. 4.
On account of the revision petition being barred by limitation the learned Additional Sessions Judge did not go into the merits of the matter. 5.
A perusal of the criminal complaint filed by the petitioner would CRL.M.C. 2588/2013
evince that the matter is of a kind where no investigation by the police is warranted and thus the order passed by the learned Metropolitan Magistrate is even otherwise lawful. The petitioner would be free to lead evidence and establish the charge laid in the complaint filed by him before the learned Metropolitan Magistrate.
6.
The petition is dismissed.
