FAO(OS) 88/2016 We have heard the learned counsel for the parties. The appellant has filed an application under Order XXXIX Rule 4 CPC being IA No.2739/2016. That has been listed by the learned Single Judge for hearing on 02.08.2016.

In the circumstances narrated in the appeal and the submissions made by the learned counsel for the parties, we are of the view that the ends of justice would be met if the application is

taken up for hearing at an earlier date. Therefore, we direct that the said application be placed before the learned Single Judge for hearing on 04.04.2016.

The appeal stands disposed of.
