1. The present appeal under Section 299 of the Indian Succession Act, 1925 assails the judgment dated 26.04.2008 passed by the learned Additional District Judge, Delhi in probate case no. 298/2006, by which the trial court allowed the probate petition.

2. There is no representation for the appellant.

3. It is seen from the earlier orders that the sole appellant had died and the notice that was issued to the appellant has returned with an endorsement that there is no such person.
