% 03.05.2018 After some hearing, the counsel for the petitioner submits, on instructions, that he may be allowed to withdraw the present petition filed under Article 227 of the Constitution of India and the applications filed therewith and instead be given liberty to bring a challenge to judgment dated 15.05.2013 of the civil Judge passed in suit No.426/2012, by way of an appeal under Section 96 of the Code of Civil Procedure, 1908 (CPC) before the appropriate court, the contentions to be urged in the said appeal including objections to the jurisdiction of the civil court. The petition and the applications filed therewith are dismissed as withdrawn with liberty as prayed for granted. R.K.GAUBA, J.
