W.P.(C) 2661/2016 & CM No.11251/2016 The petitioner has filed the present petition, inter alia, impugning the charge-sheet dated 16.07.2012 issued by respondent No.1 Learned counsel for the petitioner submits that the petitioner is a permanent employee of Haryana State Roadways working in capacity of a car driver. The petitioner was arrested on 28.03.2012 from his house. He further submits that no recovery of bribe money has been made from the petitioner. He also submits that despite there being no charge or evidence

against the petitioner, suspension order dated 18.05.2012 was issued by respondent No.1 against the petitioner. Thereafter, respondents issued charge sheet dated 16.07.2012 under Rule 7 of Haryana Civil Services (P&A) Rule 1987 against the petitioner. The petitioner vide letter dated 04.09.20125 submitted his reply to the memorandum of charge and also gave a representation dated 04.11.2015.

After some arguments, Mr. Inderpal Khokhar, learned counsel for the petitioner seeks permission to withdraw the present petition and application with liberty to make the representation to the inquiry officer. As prayed, the petition as well as application are dismissed as withdrawn.

However, the petitioner is at liberty to move an appropriate application before the inquiry officer who will decide the same in accordance with law.
