This is a petition filed under Section 9 of the Arbitration and Conciliation Act, 1996 seeking the following reliefs: " a. Stay the operation of Notice dated 11.11.2025 issued by the Respondent and further direct the respondent not to take any coercive steps in terms of the notice dated 11.11.2025. b. Direct the Respondent to deposit/pay an amount of Rs. 61,39,368/- as an admitted payment for work done by the petitioner. c. Direct the Respondent to not to issue any fresh tender till the pendency of the present petition;
d. Direct the Respondent to not to take any adverse action as stated in the impugned letter e. In the alternative, Direct the Respondent to not to bar the Petitioner from participating in the tender process for the balance works ..."

For the reasons stated in the petition, issue notice. 3.
Mr. Jetly, learned CGSC accepts notice on behalf of the respondents and objects to the jurisdiction.

Mr. Bakhru, learned counsel for the petitioner on instructions seeks and is granted liberty to approach the Court at Jammu for redressal of its grievance as the situs of the project is at Jammu and he may be granted interim protection for 10 days.

After some arguments, learned counsel for the respondents on instruction states that the respondents shall not take any precipitative action for a period of 7 days from today to enable the petitioner to approach the competent Court of jurisdiction at Jammu.

It is stated by learned counsel for the respondents that as per the email received he is only entitled to give a statement for seven days. However, considering the fact that the brother of learned counsel for the petitioner is getting married, I consider it appropriate to extend the protection to ten days.

Taking the statement made on behalf of the respondents on record and binding the respondents to the same the petition is disposed of. 8.
