A Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner seeking quashing of FIR No.740/2014 under Section 308/341 IPC registered at Police Station Patel Nagar, Delhi.

As per the facts narrated in the FIR, on 01.10.2014 at around 05:30 P.M the Complainant was going to get his mobile recharged on his scooter. When he reached in front of Anand Nursing Home, the Petitioner, who was already known to the Complainant started abusing him. When the Complainant objected to it, the Petitioner hit a bamboo stick on the head of the Complainant. Petitioner ran away from there. The Complainant informed about the incident to his father, who called the Police. The Complainant got first aid from Patel Hospital and on his Statement the present FIR got registered against the Petitioner.

It is submitted that vide MOU dated 12.11.2025 the Petitioner and Respondent No. 2 have already sorted out their all differences with the intervention of their respective persons of the vicinity and they have left no grudge or grievance against each other in any manner whatsoever. Therefore, the Petition be quashed.

The Complainant is present in the Court and submits that the matter stands settled with the Petitioner who has filed the present Petition. He has No Objection if the FIR is quashed against the Petitioner on account of the settlement already arrived at between the parties. 7.

The parties are present before this Court in-person today, and have been identified by their counsel and Investigating Officer concerned. The Petitioner submits that he is working as a Salesman at a shop and the Complainant is working in a Marketing Firm.

In view of the submissions made, the Petition is allowed. Accordingly, the FIR bearing No. 740/2014 registered at Police Station Patel Nagar, for offences punishable under Sections 308/341 of the Indian Penal Code, 1860 with all the subsequent proceedings and the charge sheet is hereby quashed qua the Petitioner.
