A Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioners seeking quashing of the proceedings in case FIR No.838/2015 under Section 498A/406/34 IPC registered at Police Station Madhu Vihar, Delhi on the ground that the allegations of cruelty have been not accepted either in the Divorce Petition which has stood finalized or in the Domestic Violence Petition, where also the allegations of cruelty have not been accepted. It is on the same ground that the Chargesheet has been filed and which is liable to be quashed. 4.
