This is an application for grant of anticipatory bail. The FIR in this case has been registered under Section 110(3)(5) BNSS, 2023. 2.

As per allegations in the FIR, a rickshaw was being loaded with plywood at the road and the plywood hit the vehicle of the complainant, whereupon, he asked the rickshaw puller to handle the plywood in a safe manner, and in the meanwhile, applicant, who is stated to be the owner of the plywood shop, came there and threatened the complainant. The boys/workers of the shop also abused the complainant. A scuffle started and during scuffle, petitioner asked his workers to kill the complainant, and thereafter, those boys started beating the complainant with a stick and danda, due to which, complainant suffered injuries on his head and hand. 3.

other co-accused persons, and therefore, is not required for any further custodial investigation.

It is further submitted that even though the complainant suffered grievous injuries, he was discharged from the hospital on the same day. 5.

Keeping in view the fact that applicant has already joined the investigation and is not required for further investigation and as also the fact that the complainant has since been discharged from the hospital, the application is allowed and it is directed that in the event of arrest, petitioner be released on his furnishing a personal bond in the sum of Rs. 20,000/- with one surety of the like amount to the satisfaction of Investigating Officer/Arresting Officer with condition that petitioner shall neither threaten nor intimidate the witnesses and shall not tamper with the evidence.
