O R D E R

% 03.04.2018 Petitioner no.1 (husband) and respondent no. 2 (wife) state that they have settled their disputes amicably before the Counselling Cell, Karkardooma Courts, Delhi on 4th May, 2017 and are living together; therefore, FIR No. 436/2016 under Sections 498-A/406 IPC and Section 4 of the Dowry Prohibition Act, 1961 registered at Police Station Shahdara on the complaint of respondent no. 2 may be quashed. Respondent no. 2 is present in Court along with her counsel and has been identified by ASI Harvindra Singh of police station Shahdara. Respondent no. 2 submits that

she has settled the matter with the petitioner no. 1 of her own free will and without any undue force, pressure or coercion. Respondent no. 2 further submits that presently she has no grievance against the petitioners and is living in the matrimonial home for the last one year. Respondent no. 2 further submits that she has no objection in case FIR is quashed against the petitioner no.1 and his relatives, that is, petitioner nos. 2 and 3. Affidavit of respondent no. 2 is also on record at pages 21-22. Keeping in mind that husband and wife have started living together after resolving their differences, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, FIR No. 436/2016 under Sections 498-A/406 IPC and Section 4 of the Dowry Prohibition Act, 1961 registered at Police Station Shahdara and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
