The present petition, filed under Section 115 of the Code of Civil Procedure, 1908 ["CPC"], is directed against the order dated 23.07.2025 passed by the Trial Court in Suit No. CS SCJ 581/2023 before the Civil Judge, North District, Rohini Courts, Delhi, whereby the application filed by the petitioner (defendant No. 2 in the suit) under Order XVI Rule 3 read with section 151 CPC, was dismissed.

The application in question sought the summoning of an additional witness. Inasmuch as no revision is maintainable against such an order under the proviso to Section 115(1) CPC, Mr. Virendra Singh, learned counsel for the petitioner, seeks permission to withdraw the present revision petition, with liberty to avail appropriate remedies in accordance with law.

The revision petition, alongwith pending applications, is accordingly dismissed as withdrawn, with liberty as aforesaid.
