Applicant seeks regular bail in case arising out of FIR No.0467/2022 dated 02.07.2022, registered at P.S. Govind Puri for commission of offences under Sections 365/34 IPC. When the charge-sheet was filed the applicant was charged with offences under Sections 302/201/34 IPC. 2.
Learned counsel for the applicant submits that there is no eye witness of the incident in question. So much so that the dead body in question has not been identified by anyone. He submits that neither FSL report related to the CCTV footage nor report regarding DNA has been received so far and the matter is getting delayed, unnecessarily.

During course of the arguments, learned APP for the State, on instructions from I.O., submits that the requisite reports have already been received and it will be ensured that these are supplied to the applicant, without any further delay.

Learned APP for the State submits that out of 36 cited witnesses, the prosecution has already examined 27 witnesses. 5.
Let there be no further delay in the matter particularly, keeping in mind the fact that incarceration period of the applicant is around four years. 6.
Learned counsel for the applicant, without prejudice to his rights and contentions, does not press the present application at this stage. He, however, prays that request be made to the learned Trial Court to expedite the trial and to supply him with the copies of the reports, without any further delay. 7.
In view of the above, the present application is disposed of, as not pressed.

All rights and contentions of the parties are reserved. 9.
The next date before the learned Trial Court is stated to be 30.04.2026 and prosecution would ensure that all such reports are duly supplied to the applicant on the said date and, thereafter, learned Trial Court would make best endeavour to dispose of the abovesaid trial as expeditiously as possible, preferably within a period of 6 months.

In case, the case is not disposed of within the abovesaid time-frame, the applicant would be at liberty to approach this Court afresh for grant of bail.
