Learned counsel for the appellant submits that the parties are brothers and that the appellant seeks leave to withdraw the present appeal with liberty to move an appropriate application before the concerned Court. It is stated that the respondent's share in the property of the father is now available for attachment.

Leave, as prayed for, is granted. Accordingly, the appeal is dismissed as withdrawn alongwith pending application with liberty as prayed for. The application filed, if any, shall be considered by the Trial Court in accordance with law. The respondent shall also be at liberty to raise the objections, as may be available to it.
