Learned counsel appearing on behalf of the parties are ad idem that since the Arbitral Award dated 16.08.2024 is under challenge by both parties, it would be apposite that the Award be set aside and the disputes be referred for adjudication de novo. 2.

Having regard to the joint submission advanced by the parties, this Court deems it appropriate to set aside the impugned Arbitral Award.

In view thereof, the parties are at liberty to take appropriate steps for appointment of their respective nominees for the constitution of the Arbitral Tribunal for adjudication of the disputes inter se the parties in accordance with law.
