% 01.08.2025 CM APPL. 46815/2025 By way of the present application filed under Order XXIII Rule 1 read with section 151 of the Code of Civil Procedure 1908, the appellants seek to withdraw the appeal in terms of the settlement contained in Deed of Settlement dated 13.06.2025 signed between the parties. Learned counsel is present on behalf of the respondents; and does not oppose the present application.
Some of the party-respondents, who are ordinarily residents abroad, have also joined the proceedings via video-conferencing. In view of the above, the application is allowed. Application stands disposed-of.
RFA 887/2024 In view of the order passed above, the appeal is disposed-of as withdrawn, holding the parties bound by the terms of Deed of Settlement dated 13.06.2025.
