By the present petition, the petitioner seeks following prayers :
(a) Issue an appropriate Writ, Order or direction in the nature of a writ of mandamus thereby directing the respondent no. 1 to register an FIR against the aforesaid incident and the same may kindly be investigated through an independent investigating agency other than the respondent no.2.
(b) Issue any other or further writ, order or direction in favour of the petitioner and against the respondents in view of the above facts and circumstances of the case, in the interest of justice.

collect his company records, personal files, cash and his cheque books which were kept in the said office.

The learned counsel for the petitioner submits that the complaint was given long back on 28.09.2024, however, no action has been taken till date.

The Hon'ble Apex Court in the case of Sakiri Vasu v. State of Uttar Pradesh : (2008) 2 SCC 409 categorically held that the High Court, while exercising jurisdiction under Article 226 of the Constitution of India, should ordinarily not direct registration of an FIR.

In terms of the provisions of the Code of Criminal Procedure, 1973, the petitioner has various remedies. If no action is taken in a complaint, a further complaint can be given to the concerned DCP and thereafter, the complainant is also at liberty to file an application under Section 156(3) of the CrPC seeking action before the learned Metropolitan Magistrate. 6.
In view of the above, the present petition is disposed of with liberty to the petitioner to file an appropriate application before the learned Metropolitan Magistrate.
