The present petition has been filed by the Petitioner under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking issuance of a writ in the nature of Habeas Corpus or any other appropriate writ or order directing Respondents to trace and produce the missing wife of the Petitioner (Ms. Sunita Rani) along with the 14 year old minor daughter (Miss 8A9) and 9 year old minor son (Master 8O9) of the petitioner.

The brief facts of the case are that on 14.08.2025, at around 9:00 PM, the petitioner returned home to find the same locked and his wife along with minor son and daughter missing. Further, some jewellery and cash of twenty-two thousand rupees was also found missing. petitioner wrote to SHO, PS Prem Nagar raising concern that he believes a man named Munna Lal (respondent No. 4) has kidnapped the missing persons.

Today, Ms. Sunita Rani is present in court and submits that she is presently residing in Noida along with her minor children and does not wish to go back to her husband.

Our interaction with her clearly indicates that she does not want to go with the petitioner.

Since Ms. Sunita Rani is major and can take her own independent decision, no further order is required to be passed in the present petition. 6.

Resultantly, the petition is disposed of in aforesaid terms. 7.

All rights and contentions of parties are left open.
