In compliance with the order dated 08th May 2024, an undertaking has been filed by respondent no.1 stating that they shall repay the entire amount (only principal amount) for the year 2009-2020 to the petitioner within the stipulated period.

The said undertaking has been present by Mr. Barun Kumar Sinha, Counsel for respondent no.1.

The said affidavit is taken on record.

Mr. Ravi Sikri, Senior Counsel, who appears for petitioner, states that some confirmation as to how much time will they take to pay shall also be provided.

In this regard, the petitioner shall provide the total calculation of the amounts paid during the period 2009-2020 (only the principal amount), and shall communicate to Mr. Barun Kumar Sinha, Counsel for respondent no.1, through a written communication, within the next two weeks. 6.

The amounts shall, thereafter, be paid within six months to the petitioner in four equal instalments.

Application is, therefore, disposed of with the aforesaid directions. W.P.(C) 5658/2008 1.

Mr. Barun Kumar Sinha, Counsel for respondent no.1 states that, considering these circumstances, that respondent no.1 had been employed elsewhere, he has no objection if the award dated 31st January 2008, passed in ID No.153/2003, is set aside qua respondent no.1. 2.

Considering that there is no other workman as a party in this petition, Mr. Ravi Sikri, Senior Counsel for the petitioner states that the petition can be disposed of on these terms.

Accordingly, the petition is disposed of.

Pending applications, including application under Section 340 of the Code of Criminal Procedure, 1973 (Cr.P.C.) are, therefore, rendered infructuous and are disposed of.

Liberty is given to the petition to seek appropriate remedies if there is any non-compliance of the undertaking given before this Court by respondent No.1.
