% 29.09.2016 REVIEW PETITION No.439/2016 Petitioner is seeking a review of the order passed by this court on 18.7.2016. This Court had noted that the order dated 19.10.2015 (grievance of the petitioner) is an order passed by the Tehsildar. The matter had been passed over as the vehement contention of the learned counsel for the petitioner was that there was no remedy available to the petitioner qua this order which has been passed by the Tehsildar on 19.10.2015.

At the cost of repetition, while disposing of this writ petition, on 18.7.2016 this Court had noted that this order was appealable before the Financial Commissioner. The consistent stand of the respondent is also that the impugned order is appealable before the Financial Commissioner.

The application seeking modification of the order dated 18.7.2016 is even otherwise not maintainable because a conscious

submission had been by learned counsel for the petitioner on that date that he sought permission of this Court to withdraw this petition. This Court also notes the additional stand of the petitioner (at this stage) that if he is relegated back to the Financial Commissioner his case would be delayed and he would get endless dates. This is not a ground seeking review of the order dated 18.7.2016. Application dismissed.
