1. This is a joint application on behalf of the Plaintiff and Defendant nos.1.2 & 3 under order XXIII Rule 3 read with Section 151 of the Code of Civil Procedure.
2. The present suit is for partition of property Municipal No.4528, Block No.ll, at 7/25, Daryaganj, Delhi. The parties are real brothers and sisters. It is stated that in the larger interest of the family and to maintain peace and harmony and good relations between the families, they have arrived at an amicable settlement as recorded in the Memorandum of Oral Family
Settlement dated 9th May 2019 which is annexed along with the present application.
4. Defendant Nos. 2 and 3 are present in person. They confirm that they have signed and executed above mentioned Memorandum of Oral Family Settlement as also the present application along with the accompanying affidavits. Wife of Defendant No. 1 who is present in the Court today also confirms the settlement.
5. Learned counsels for the parties support and confirm the settlement and pray that the suit be decreed in terms thereof.
6. For the foregoing reasons, the suit is decreed. The present application and the Memorandum of Oral Family Settlement shall form part of the decree. Parties shall remain bound by the terms and conditions stated in the Family Settlement.
7. The decree sheet be prepared.
8. The next date is cancelled.
