CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 15.10.2015 I.A. No.21999/2015 (u/O 23 R 3 CPC) Defendant no.4 is the daughter of defendant no.1 and defendant no.2 and is minor.

Defendant no.4 is permitted to be represented through her mother Mrs. Preeti Abrol, that is, defendant no.2. Parties have settled their disputes before the Delhi High Court Mediation and Conciliation Centre on the terms and conditions as stipulated in the Settlement Agreement dated 2nd June, 2015, which has been signed by the parties as well as their counsels and also the mediator. Settlement Agreement along with its annexure, that is, Memorandum of Settlement are

collectively marked as 'Mark C-1'.

Parties have also entered into a Corrigendum to the Memorandum of Understanding dated 8th August, 2015, which has also been annexed with the Settlement Agreement and marked as 'Mark C-2'. I do not find the terms of 'Mark C-1 & C-2' to be in conflict with any law. Parties shall remain bound by the terms of settlement. As prayed by the parties in this application, suit is disposed of in terms of 'Mark C-1' and 'Mark C-2'.

Since parties have settled their disputes through the process of mediation, let court fee be refunded to the plaintiff and a necessary certificate be issued in this regard by the Registry. All the other pending miscellaneous applications are disposed of as infructuous. Date fixed in the matter, that is, 7th December, 2015 is cancelled.

A.K. PATHAK, J.
