% 07.09.2017 It is submitted that petitioner and respondent no.2 have settled their disputes amicably before the Mediation Centre, Rohini Courts, New Delhi on 8th October, 2015 with regard to FIR No. 13/2015 and FIR No. 714/2014 both registered at PS Adarsh Nagar. It is further submitted that by the settlement arrived at between the parties, it was decided that the present FIR would also be quashed. Photocopy of report of the Mediation Centre has been placed on record as Annexure „B‟. Para 8 of the said settlement reads as under:- Para 8 : "Complainant/wife would cooperate with the respondent/ accused and other persons who are arrayed as accused in FIR No.1166/2015 registered at PS
Prashant Vihar under Section 195A/506 IPC for filing the petition for quashing of FIRs and would submit her affidavit and make statement before the High Court of Del hi in accordance with law."
Petitioner no.2 and 3 were not party to the said settlement but have been referred in Clause 8 as "other persons". FIR No.1166/2015 under Section 195-A/506 IPC was registered at PS Prashant Vihar on the complaint of respondent no.2. Smt. Priya Kashyap has signed the settlement / agreement dated 8th October, 2015 before the Mediation Centre wherein in Clause 8 she has been referred to as "complainant/ wife".
Respondent no.2 Smt. Priya Kashyap is present in Court along with her counsel. She has been identified by SI Narender of police station Prashant Vihar. She submits that she has settled the matter with the petitioner no.1 of her own free will and without any undue force, pressure or coercion. Petitioner no.1 has paid `5,00,000/- to respondent no.2 in the Court today vide a demand draft, photocopy whereof has been placed on record. She submits that with this payment, entire settled amount stands paid and she has no objection in case FIR as mentioned in the settlement / agreement Annexure B and the consequent proceedings emanating therefrom are quashed.
Keeping in mind that petitioner and respondent no.2 have settled their disputes before the Mediation Centre, in the interest of justice, FIR No.1166/2015 registered at PS Prashant Vihar under Section 195-A/506 IPC and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
