The learned Senior Counsel for the Petitioner in C.O.(COMM.IPDCR) 53/2025 and the Defendants in CS(COMM) 167/2024 submits that pursuant to order dated 10.12.2025, the Parties have been able to enter into a settlement and a Settlement Agreement dated 16.12.2025 ("Settlement Agreement") has been executed between the Parties to resolve all the disputes with regard to both these matters. The Settlement Agreement submitted in a sealed envelope is taken on record. The Court records appreciation for the efforts of Mr. Amit Sibal, Senior Advocate for assisting the Parties in arriving at the Settlement Agreement, pursuant to the request made in order dated 10.12.2025.

The learned Counsel for the Respondent in C.O.(COMM.IPD-CR) 53/2025 and the Plaintiff in CS(COMM) 167/2024 confirms that the Settlement Agreement has been executed between the Parties. 3.
In view of the above, let the Plaint be registered as Suit in CS(COMM) 167/2024.

Both C.O.(COMM.IPD-CR) 53/2025 and CS(COMM) 167/2024 are disposed of in terms of the Settlement Agreement and the Parties are bound by the Terms of the Settlement. All the pending Applications stand disposed of.

The learned Counsel for the Plaintiff prays for refund of the Court Fees paid in CS(COMM) 167/2024 on the ground that the matter is settled at an initial stage.

In view of the fact that the matter has been settled at an early stage, the Registry is directed to issue a certificate of refund of 100% of the Court The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
Fees in favour of the Plaintiff in CS(COMM) 167/2024, in terms of Section 16 of the Court Fees Act, 1870.

It is however, made clear that in case any dispute arises between the Parties and in the event, either Party approaches this Court for enforcement of the Settlement Agreement, the said Party or Parties will become liable to pay the entire Court Fees thereon.
