CRL.M.A. 8225/2026 Mr. Yugvansh Mittal, learned legal-aid counsel who had filed the present application seeks withdrawal of the same, submitting that though they had filed for modification of order dated 13.01.2026, the present application has been rendered infructuous, since the petitioner has already been released on furlough.

The application is disposed-of as infructuous. 3.

Mr. Mittal also seeks discharge in the matter, since the petitioner has engaged private counsel who has appeared in court. By way of the present application filed under section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks exemption from surrendering, since another petition bearing W.P.(CRL) No. 1464/2024 seeking his premature release, is pending for consideration before this court.

In the present matter the petitioner was directed to be released on furlough for 03 weeks vidé order dated 13.01.2026; whereupon he was released from custody on 27.02.2026, with the date of surrender being 21.03.2026.

Since the pendency of the petition seeking premature release has no bearing on the present application, by which the petitioner is seeking extension of furlough, this court is not inclined to allow the present application.

The application is dismissed. The petitioner is directed to surrender to custody by the due date i.e., 21.03.2026.

The application stands disposed-of.
