The present appeal has been filed on behalf of the appellant under Section 39(1)(iii) of the Arbitration Act, 1940 seeking setting aside of the Order/Judgment dated 27.04.2022 (hereinafter referred to as "Impugned Order") passed by the learned Single Judge of this Court in CS(OS) 2070/2012 vide which the ex-parte award dated 23.05.2012 passed by the learned Sole Arbitrator was modified. 2.

The learned counsel for the appellant states that since the Impugned Order has already been set-aside vide Judgment dated 20.02.2026 passed by a Coordinate Bench of this Court in FAO(OS) 60/2022, therefore, the present appeal has rendered infructuous. 3.

In view of the aforesaid statement, the present appeal, along with pending applications, stands disposed of.
