% 12.02.2026 By way of the present petition filed under Article 226 of the Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023 ('BNSS'), the petitioner seek quashing of case FIR No. 519/2025 dated 22.09.2025 registered under sections 69/351(2)/127(2) of the Bharatiya Nyaya Sanhita, 2023 ('BNS') at P.S.: Alipur, Delhi on consent.

Memorandum of Understanding dated 03.11.2025 ('MoU') has been signed by the petitioner and respondent No.2. 3.
Respondent No.2 is present in court. She is also represented by counsel. Though the terms contained in the MoU are cryptic, the court has interacted with respondent No.2.

The petition is also supported by affidavits of the petitioner and of respondent No. 2, alongwith proof of their IDs. 5.
The court has also briefly heard Mr. Pankaj Balyan, learned counsel appearing for the petitioner; Mr. Anand V. Khatri, learned ASC appearing for the State; as well as Ms. Gargi Sharma, learned counsel appearing for the complainant.

Upon a perusal of the record, it transpires that the petitioner and respondent No.2, both of whom are major, were in a consensual relationship and had intended to get married. However, their marriage did not fructify by reason of some objections raised by the families in relation to their compatibility as per astral charts. 7.
In her statement recorded under section 180 of the BNSS, respondent No.2 has stated that she had got the FIR registered in a fit of anger; that no offence was committed upon her by the petitioner; and that she does not wish to pursue any future action in the FIR. 8.
Chargesheet has been filed; though it is still pending consideration before the learned trial court.

It is submitted that the parties have not engaged in any monetary settlement. Petitioner and respondent No.2 are both about 25 years of age; and they now wish to live in peace and harmony going forward. 10.
Mr. Anand V. Khatri, learned ASC confirms that the State has no objection to the subject FIR being quashed.

In the circumstances, in line with the law laid down by the Supreme Court in Gian Singh vs. State of Punjab & Anr. reported as (2012) 10 SCC 303 as also in Narinder Singh & Ors. vs. State of Punjab & Anr. reported as (2014) 6 SCC 466, this court sees no reason why the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
subject FIR and all proceedings emanating therefrom should not be quashed. This court is of the view that in light of the settlement between the contesting parties, continuing with the subject FIR and all subsequent proceedings would be an exercise in futility and would not be conducive to peace and harmony between the parties. 12.
Accordingly case FIR No. 519/2025 dated 22.09.2025 registered under sections 69/351(2)/127(2) of the BNS at P.S.: Alipur, Delhi is quashed. All proceedings arising therefrom also stand closed. 13.
Petition stands disposed-of.
