The matter is taken up today as 25.11.2025 was declared as holiday on account of Guru Teg Bahadur's Martyrdom Day. 1.

This is an application filed on behalf of the petitioner seeking condonation of 16 days delay in re-filing the petition. 4.

For the reasons mentioned in the application, same is allowed. 5.

The present petition has been filed on behalf of the petitioner under Section 528 of BNSS seeking quashing of FIR No. 274/2023, under Section 420 of IPC registered at PS-D.B.G Road.

Petitioner as well as, respondent no.2 are present in Court and they have been identified by Mr. Binesh Kr. Khatri, learned counsel for the petitioner as well as SI Kiran Yadav, PS-DBG Road. 9.

The brief facts of the case are that marriage between petitioner and son of respondent no.2 was solemnized on 18.04.2017 according to Hindu Rites and Customs. However, on account of some temperamental issues certain disputes arose between petitioner and son of respondent no.2 they started living separately.

A complaint was filed by respondent no.2 with allegations of deficient amount of Rs.2,30,000/- lying in his salary account. On enquiring about the same, respondent no.2 found that his contact number has been replaced with the contact number of petitioner in the said account and the aforesaid amount was deducted towards consumer and personal loans in Bajaj Finance without his knowledge, which led to the registration of the present FIR against the petitioner.

During pendency of the proceedings, the parties have amicably resolved their disputes and arrived at a settlement, the terms whereof have been reduced in writing in the memorandum of understanding (MOU) dated 04.09.2024, which is annexed as Annexure-P2 to the present petition. 12.

In terms of the said settlement, petitioner and son of respondent no.2 decided to dissolve their marriage by filing a petition for divorce by way of mutual consent. Accordingly, petitioner and respondent no.2 have obtained a decree of divorce dated 19.11.2024.

settled the matter with the petitioner herein and does not want to prosecute the criminal proceedings any further has no objection in case the FIR is quashed.

In view of the fact that the petitioner as well as respondent no.2 have amicably settled their disputes and regard being had to the statement made by complainant, this Court is of the view that no useful purpose will be served in continuation of criminal proceedings and it will be an exercise in futility.

It is, thus, in the interest of justice that the present FIR and all the other proceedings emanating therefrom be quashed. 16.

Consequently, the petition is allowed and the FIR No. 274/2023, under Section 420 of IPC registered at PS-D.B.G Road alongwith all other proceedings emanating therefrom, is quashed.

The petition stands disposed of in the above terms. 18.
