Matter is taken up today as 25.11.2025 has been declared as a holiday on account of 350th Anniversary of Guru Teg Bahadur's Martyrdom Day. 2.

This writ petition is filed on behalf of the Petitioner under Article 226 of the Constitution of India seeking the following reliefs:- "(i) A Writ of Mandamus or any other appropriate Writ, Order or Direction in the nature of Mandamus directing the Respondents to trace out the complete file bearing number F-1 (1135)08/TC/Legal including the page No. 28 onwards and its subsequent proceedings and file the same on record before this Hon'ble court and further directed the respondent No.1 to keeping the said file and pages in safe custody for future references.

(ii) A Writ of Mandamus or any other appropriate Writ, Order or Direction in the nature of Mandamus commanding the Respondents not to take any punitive/coercive action in respect of shops/portion occupied by the Members of the petitioner/occupiers/ aggrieved persons without filing the file no. F-1(1135)08/TC/Legal and without giving adequate opportunity of being heard to the occupiers of the shops. (iii) A Writ of Mandamus or any other appropriate Writ, Order or W.P.(C) 17923/2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Direction in the nature of Mandamus commanding the Respondents to consider and declare the Representation of the members of the petitioner and come forward with some scheme/policies existed and made by the notification dated 13.12.2011 for the benefit and protection of the Constitutional rights of the members of the petitioner. (iv) A Writ of Prohibition to restrain the Respondent no. 1 and 4 from carrying the demolition action schedule further if any. (v) A writ of mandamus or any other appropriate Writ, Order or Direction in the nature of Mandamus directing the Respondents to pay the costs of this petition to the Petitioner (vi) Pass any other or further directions, orders or writ as this Hon'ble Court may, in the facts and circumstances and in the interest of justice deems fit and proper".

Admittedly, Petitioner has filed a Civil Suit before the competent Court being CS No. 322/2018, wherein vide order dated 27.04.2023, learned Trial Court has directed DDA to keep the concerned file, which is subject matter of this petition, in safe custody and produce the same when directed by the Court albeit the stand of DDA is that relevant file is not traceable. By this petition, Petitioner seeks a direction to DDA to trace out the complete file bearing No. F-1(1135)08/TC/Legal, including page 28 and onwards. 4.

Since the suit is pending before the Trial Court, which is also looking into the custody of the aforesaid file and direction has been issued to DDA to produce the file, there is no reason why this Court should interfere in these proceedings in the present writ petition. The writ petition is accordingly dismissed with the pending application.
