O R D E R

% 20.12.2017 The respondent has today handed over to the petitioner a bankers' cheque for Rs.10 lakhs. Two PDCs have also been handed over dated 25.12.2012 and 10.01.2018 for Rs.30 lakhs each. Mr.Balwant Singh who is authorised by the Board of Directors of the respondent Company to represent the respondent Company is present in court and undertakes on behalf of the respondent that the PDCs when presented shall be duly encashed by the bankers of the respondent. Above submission of Rs.70 lakhs presents full and final settlement of the dues of the petitioner.

Binding the respondent to the undertaking given in court today, the present petition stands disposed of.

In the eventuality the cheques are returned unpaid, liberty is granted to the petitioner to take steps as per law including seeking revival of the present winding up petition.

It is made clear that the date mentioned in the last order i.e. 20.12.2018 be read as 20.12.2017.
