The present writ petition has been filed seeking directions to the respondent no.1/MCD, for taking action against the illegal construction upon the property bearing No. NZ-684, Gali No. 6, Raj Nagar, Part-I, Palam Colony, New Delhi-110077.

Status report has been filed on behalf of the respondent no.1/MCD. 2.1.

A copy of the status report has been handed over in Court. The same is taken on record.

In terms of the status report, the subject property was inspected on 5th August, 2025 and it was found that construction was in process without any valid permission/sanctioned building plans. Accordingly, the property was booked on 5th August, 2025 and a Show Cause Notice was served on the owner/builder. Subsequently, a demolition order was passed in respect of the unauthorised construction on 6th October, 2025, followed by a Work Stop Notice under Section 344 (2) of the Delhi Municipal Corporation Act, 1957, sent to the respondent no.2/SHO, P.S. Palam.

In the status report, it has been further stated that on account of ban imposed on demolition activities in the months of November 2025 to January 2026, no demolition action could be taken against the subject property.

Counsel for the private respondent no.5 submits that the demolition order has not been served on him.

Let a copy of the Show Cause Notice, as well as the demolition order, be supplied to counsel for the respondent no.5. 7.
In this view of the matter, the present writ petition is disposed of while directing the respondent no.1/MCD to proceed to take action against the subject property expeditiously in accordance with law. 8.
All rights, contentions and legal remedies of the private respondent/owner/occupier are kept open.
