O R D E R

% 16.04.2018 Vide the present petition, the petitioner has sought quashing of Bill No.189109 dated 11th December, 2017, whereby a sum of Rs.56,79,434/- towards Property Tax, has been demanded from the petitioner for the period from 1999 to 2016-17, in respect of the Petrol Pump being run by the petitioner at Mansingh Road, Prithvi Raj Road, New Delhi.

Learned counsel for the petitioner submits that till date, the petitioner has not received a copy of the Assessment Order which is alleged to have been passed on account of which the aforesaid bill has been raised by the respondent.

At this stage, Mr.Arjun Mitra, who appears on advance notice for the respondent, submits that an assessment order was duly passed and assures the Court that a copy thereof would be supplied to learned counsel for the petitioner within two days.

In view of the undertaking given by learned counsel for the respondent, to provide a copy of the Assessment Order to learned counsel for the petitioner within two days, the learned counsel for the petitioner seeks leave to withdraw the present petition with liberty to file an appropriate appeal under Section 115 of the NDMC Act and prays that the respondent may be restrained from taking any coercive steps till the petitioner's appeal is listed. Learned counsel for the petitioner submits that immediately upon receipt of the copy of the assessment order, the petitioner will take steps to file a statutory appeal within the provided period of thirty days. In view of the above facts, the respondent is directed not to take any coercive action against the petitioner for the next thirty days.

The petition is disposed of as not pressed with liberty as prayed for.
