This is a petition under Article 226 of the Constitution of India read with Section 528 of BNSS for quashing of FIR no. 0218/2025, under Section 93 of BNS, PS Welcome and proceedings emanating therefrom. 2.

Issue notice. Notice is accepted by the Ld. ASC appearing for the State submitting that investigation is complete and charge sheet has since been filed in Court.

that on the basis of allegation made in the FIR, ingredients of Section 93(1) BNS are not attracted. However, upon being informed that the FIR is already registered and the petitioner may make such submission before the Trial Court at the stage of charge, the Ld. Counsel seeks permission to withdraw the petition seeking liberty to urge his submission before the Trial Court.

The statement made by the Ld. Counsel is taken on record and petition is dismissed as withdrawn with liberty to urge all his contentions before the Ld. Trial Court at the stage of charge.
