Learned counsel for the respondents states that the present petition is patently misconceived as the respondent No.1-Staff Selection Commission had duly replied to the legal notice issued by the counsel for the petitioner, by sending a reply dated 30th December, 2015, informing the petitioner, who hails from the State of Uttarakhand and had applied for the post of a Constable (GD) in the BSF, CISF, CRPF and SSB Examination-2011, that he had obtained 42 marks in the examination, whereas the cut off marks for all the Forces was much higher. 2.

Learned counsel for the respondents states that the petitioner belongs to the unreserved category of candidates whose cut off marks were not below 59 in any of the Forces whereas he had only obtained 42 marks.

At this stage, learned counsel for the petitioner seeks liberty to withdraw the present petition.

The petition is dismissed as withdrawn.
